Access logs can help an internal investigation establish when an account accessed a system or record. That does not give an employer a general licence to monitor employees. When a log collected for security or operations is used for a new investigative purpose, the purpose, legal basis, access scope and evidential limits must be reviewed again.

This article explains how businesses prepare a specific analysis, restrict privileged access and respect the limits of technical records. It focuses on Articles 5, 6, 12 to 15, 24, 25 and 32 GDPR and section 1 of the Austrian Data Protection Act. General performance monitoring, video surveillance and whistleblowing-channel data are separate topics.

Initial assessment

Is your access-log analysis prepared?

Answer the questions about the reason, log source and access. The result shows which documents may be missing before an internal investigation begins.

01 Question 1

Is there a specific reason for the investigation?

Describe the event, affected period and systems. General curiosity about user behaviour is not an investigation scope.

Your orientation

01

The reason or investigative purpose is too broad.

Describe the event, systems and necessary period. Separate the original security purpose from the new analysis and identify a valid legal basis.
02

The data scope or access group is still too broad.

Limit the analysis to the required systems, accounts, fields and period. Create a role matrix and control HR, IT administration and external support in particular.
03

The technical evidence is being overestimated.

Record what the log actually shows and which conclusions need further evidence. Separate account, person, time, action, motive and employment-law assessment.
04

Information, retention or erasure remains open.

Set the investigation end, responsibility, retention reason and known copies. Review information and data-subject rights separately and record erasure or the specific reason for keeping data.
05

The essential controls are prepared.

Bring the reason, purpose, legal basis, data scope, roles, evidence limits, information route and erasure decision together in an investigation file. Repeat the review if log sources or the period expand.

Classify employee data in the employment context

Access logs may contain a user account, workstation, time, target system, record and action. Combined with an employee identity, they are personal data. Section 1 of the Austrian Data Protection Act protects confidentiality of personal data where a legitimate interest in secrecy exists. A business log does not lose that protection because it was generated technically.

Article 88 GDPR permits more specific rules for processing in the employment context. It does not create a general exemption for every control. The specific work process, internal rules, possible participation rights and the position of the person concerned must be reviewed alongside the GDPR and the Austrian Act.

Do not immediately classify the event as a breach of employment duty. The lawfulness of the data analysis and the employment-law assessment are connected but distinct steps. The site section on employee data protection provides the framework for this assessment.

Secure the investigation access group

Article 5(1)(f) GDPR requires appropriate security, including protection against unauthorised processing. Articles 25 and 32 GDPR address design and a level of security appropriate to the risk. A shared folder accessible to every manager or administrator is therefore not enough for an investigation.

Name the investigation team, the necessary role of HR, technical support and any external expert. Define which log fields each role may see. A system administrator may preserve the technical source without automatically receiving the complete investigation file.

Privileged access must itself be controlled. Log retrievals, exports, changes and disclosures from the investigation file. The article on documenting technical and organisational measures supports accountability but does not replace an individual role and access matrix.

Separate evidence scope and log integrity

An access log can identify technical events such as an account, time, application and target object. It therefore first shows that an event was recorded under a particular account. It does not automatically show who acted, what the motive was or whether an employment duty was breached.

Preserve the source, export path, period and time zone. Record whether entries can be missing, whether technical accounts are used and what changes to the log source are possible. An investigation is stronger when logs are compared with permissions, duty schedules, ticket histories or other admissible records.

Data minimisation also limits evidence preservation. Export only fields and periods needed for the defined question. A larger data set creates additional risks and makes the investigative purpose harder to explain later.

Balance information, access and the investigation

Articles 12 to 15 GDPR address clear information and the right of access. Businesses should therefore establish what employees were told about log processing and how a specific analysis is covered by existing privacy information. Missing or overly general information can affect the assessment of a later investigation.

An ongoing investigation can raise questions about the order of information, an access request and evidence preservation. Whether and to what extent a restriction is permitted depends on the specific legal basis and circumstances. A blanket promise of secrecy is no more reliable than a blanket refusal of every access request.

Record the decision: what information was given, what request was made, which data are concerned and who reviews the response. The article on access requests under Article 15 GDPR explains the general process. The investigation file also needs a specific interest and data-scope assessment.

Set retention and close the investigation

Article 5(1)(e) GDPR requires storage limitation. Raw logs, an investigation report, attachments and any employment documentation can have different purposes and retention questions. The GDPR does not produce one fixed period for every investigation.

Before analysis, set the investigation end, required results and documents that may still be necessary afterward. Review temporary exports, local files, emails, tickets, backups and provider copies. Article 17 GDPR matters where the purpose ends or an erasure request affects continued storage.

The closure record should identify the reason, source reviewed, scope, result, open questions, erasure decision and responsible person. Keep only evidence needed for accountability, legal defence or another valid duty. The section on data protection governance and compliance supports the wider accountability structure.

Avoid common errors in internal log investigations

The purpose is changed after collection: A security log is used for general employee monitoring without a new assessment.

The search has no boundary: All accounts, periods and fields are analysed instead of the specific event.

The account is treated as the person: Technical accounts, shared access, substitutes and administrator rights are ignored.

The investigation group is too large: Managers, IT and HR see more raw data than their tasks require.

Technical entries are treated as complete proof: Motive, identity and breach of duty are asserted without further evidence.

Closure is forgotten: Exports and copies remain in folders, mailboxes or tickets after the investigation ends.

Practice check before analysing access logs

Start with the investigation instruction. Describe the event, systems, period, affected data and specific question. Record the original reason for collecting the log beside it. Only then can further use be assessed properly.

Create a role matrix for the investigation, HR, IT administration and external support. Limit fields and exports. Preserve the source in a traceable way and note technical details such as shared accounts, time zones, missing entries or later changes.

Before closure, address information, access, retention reason and erasure. Separate raw data, analysis and report. This keeps clear which fact the log proves, which conclusion is drawn and where additional legal or employment-law review is needed.

FAQ

Questions about access logs in investigations

May an employer analyse access logs for an internal investigation? +
It can be lawful in an individual case, but it requires a specific investigative purpose, a valid legal basis, a necessary data scope and a limited access group. Technical availability does not permit general performance monitoring.
Does a log entry prove that a particular employee read the data? +
A log entry first identifies a technical event under an account. Whether the person acted, what the motive was and whether a duty was breached must be assessed with the technical circumstances and further admissible evidence.
How long must access logs from an investigation be kept? +
There is no single period for every investigation. Raw logs, analysis and closure records each need a specific purpose and necessary duration. After closure, copies and exports must be reviewed and data no longer needed must be erased.
May administrators see the complete investigation file? +
Administrative rights do not by themselves create unlimited professional access. Roles should be separated by task and necessity. Technical preservation, exports and control of privileged access should be documented separately.
Must employees be informed about analysis of their access logs? +
Information duties and an access request must be assessed under Articles 12 to 15 GDPR and the circumstances of processing. A blanket promise of secrecy or a blanket refusal of access does not reflect the specific legal position.

Prepare an internal log investigation

We review the reason, original and new purpose, legal basis, log scope, roles, evidence preservation, information, retention and erasure. The investigation instruction, log description, permission matrix, planned analysis, existing privacy information and closure plan support the first assessment. This allows the technical trail to be analysed without turning one log entry into an unsupported overall conclusion.
